Terms of Service

1. Who you are contracting with

EarnWell is operated by SpaceNation Pty Ltd (“EarnWell”, “we”, “us”), trading as EarnWell. By accessing or using the platform you enter into a binding agreement with SpaceNation Pty Ltd. If you do not agree to these terms, do not use the platform.

If you are using EarnWell on behalf of an organisation, you represent that you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age in your jurisdiction.

2. What EarnWell provides

EarnWell aggregates open compensation datasets and de-identified user submissions to produce statistical benchmarks, pay bands, offer evaluations, equity summaries, and AI-generated answers about pay and market trends.

3. Informational purpose only — no professional advice

All benchmarks, distributions, AI answers, offer evaluations, pay bands, equity summaries and any other output from EarnWell — including the “Ask EarnWell” assistant — are indicative guidance only and are provided for general informational purposes. They do not constitute legal, tax, financial, accounting, employment, investment or professional advice, and are not a substitute for advice from a qualified professional in your jurisdiction. You are solely responsible for any decisions you make based on information from the platform.

4. Data accuracy

Compensation data is inherently noisy and time-sensitive. We apply statistical floors, freshness weighting and validation checks, but do not warrant that any specific value is complete, current or error-free. We provide the service “as is” and disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

5. Acceptable use

You must not: (a) submit false or misleading data; (b) use the platform unlawfully or for fraud or spam; (c) infringe intellectual property or privacy rights; (d) attempt to re-identify contributors; (e) scrape, probe, reverse engineer or interfere with the security of the platform; (f) introduce malware; or (g) resell, redistribute or sublicense the raw data or outputs. You must keep your account credentials confidential and are responsible for activity under your account.

6. Payments, subscriptions, refunds and tax

Subscriptions are sold by SpaceNation Pty Ltd and payments are processed by our payment provider, Stripe. Stripe calculates and collects applicable taxes at checkout on our behalf and provides receipts, invoices and dispute handling. See our Refund Policy for our 30-day money-back guarantee. Subscriptions renew automatically until cancelled; you can cancel at any time and access continues to the end of the paid billing period.

7. Intellectual property and licence

The platform, code, aggregated datasets, models and UI are owned by SpaceNation Pty Ltd. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the platform for your own internal business or personal use within the plan you have subscribed to. You retain ownership of the raw compensation data you submit; by submitting it you grant EarnWell a perpetual, worldwide licence to use it in de-identified, aggregated form. You must not reverse engineer the platform or circumvent its technical limits.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the platform ends; you may request an export of your data within 30 days, after which it may be deleted.

9. Limitation of liability

To the maximum extent permitted by law, SpaceNation Pty Ltd and its operators are not liable for any indirect, incidental, consequential or special damages (including loss of profits, data or goodwill) arising from your use of the platform. Our aggregate liability for any claim is capped at the fees you paid to us in the 12 months preceding the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnity

You will indemnify SpaceNation Pty Ltd against claims arising from data you submit, your unlawful or unauthorised use of the platform, or your breach of these terms.

11. Governing law

These terms are governed by the laws of Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales, Australia, unless a mandatory consumer law in your jurisdiction provides otherwise.

12. Changes

We may update these terms from time to time. Continued use after changes constitutes acceptance.
